Effective date: April 10, 2018 How To Manage a Small Law Firm II, Incorporated (“HTM,” “us,” and “we“) owns and operates one or more web and/or mobile applications, including the HTM APP mobile application and the HTM Dashboard web and mobile application (collectively, the “Apps“). We take your privacy very seriously. This page informs you of our policies regarding the collection, use, and disclosure of your personal and other data that may be collected when you use our Apps and the choices you have. We mainly use your data to provide you with the Apps, and to improve them. By using the Apps, you agree to the collection and use of this information in accordance with this Privacy Policy. Unless otherwise defined in this Privacy Policy, terms used herein have the same meaning as in our End User License Agreement (EULA), which is incorporated by reference.

Information We Collect and Use

We collect several different types of information for various purposes, but mainly to provide the Apps to you and to improve them.

Types of Data Collected

Personal Data

When registering for an account with us, while using our Apps, or when you seek to communicate with us, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data“). Personally identifiable information may include, but is not limited to:

  • Your email address
  • Your first and last name
  • Your phone number
  • Your mailing or street address, state/province, city and ZIP/postal code
  • Certain Usage Data*

*While Usage Data is essentially anonymous when collected, we cannot guarantee that it could not be used indirectly or in conjunction with other data to identify a person. We may use your Personal Data to answer your questions, and to contact you with newsletters, and information that may be of interest to you about HTM, including HTM marketing and promotional materials. You may opt out of receiving any, or all, of these communications from us at any time by following the unsubscribe link or other instructions provided in any email we send, or simply by contacting us.

Usage Data

We may also collect information that your device and/or browser sends over the Internet whenever you use our Apps (“Usage Data“). Usage Data may include information such as your computer’s Internet Protocol address (aka “IP address”), browser type, browser version, operating system, the pages and/or features of our Apps that you use and/or the content you consume, the time and date of your visits, the time spent on each page, unique device identifiers and other diagnostic use data. When you access the Apps by or through a mobile device, this Usage Data may also include information such as the type of mobile device you use, your mobile device unique ID (UUID or device identifier), the IP address of your mobile device, your mobile operating system (e.g., iOS, Android), the type of mobile Internet browser you use, the device manufacturer, App version, other unique device identifiers and other diagnostic data.

Tracking Cookies Data

We use cookies and similar tracking technologies to track activity on our Apps and hold certain information. Cookies are files with small amounts of data such as an anonymous unique identifier. Cookies are sent to your browser from a website and are stored on your device. Similar tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our Apps. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, please be advised that you may not be able to use some portions of our Apps and/or that they may not function as expected. Examples of cookies we use:

  • Session Cookies. We use Session Cookies to operate our Apps.
  • Preference Cookies. We use Preference Cookies to remember your preferences and various settings.
  • Security Cookies. We use Security Cookies for security purposes.

Use of Data

HTM uses the collected data of each type for various purposes, including:

  • To provide and maintain our Apps
  • To notify you about changes to our Apps
  • To allow you to participate in interactive features of our Apps when you choose to do so
  • To provide customer support
  • To gather analysis or valuable information so that we can improve our Apps
  • To monitor the usage of our Apps
  • To detect, prevent and address technical issues
  • To provide you with news, special offers and general information about other goods, services and events we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information

Transfer Of Data

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. If you are located outside United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. HTM will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

Disclosure of Data

We may share and disclose your Personal Information as described below. We may share and disclose Usage Data without restriction, including without limitation, as described below. Note that we may combine and use the Personal Information and Usage Data we collect from all services and products offered by us and our affiliated entities over various websites, services and/or apps to provide, protect, and improve them, and to develop and offer new services and products. We will treat you as a single user of these combined services and products.

Affiliates

We may provide your Personal Information and Usage Data to any affiliated entities we may have, including our subsidiaries. Affiliated entities are entities that we legally control (by voting rights) or that control us.  

Service Providers

We may provide access to your Personal Information and Usage Data to our trusted service providers that assist us with the operation and maintenance of the Apps. For example, we may contract with third parties to finance purchases from this app, process payments, host our servers, provide security, and provide production, fulfillment, optimization, analytics, reporting, and software maintenance and development services. In addition, our service providers will be given access to your information only as is reasonably necessary to provide the services for which they are contracted.

Business Transaction

If HTM is involved in a merger, acquisition or asset sale, your Personal Data and Usage Data may be transferred as part of that transaction. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.

Disclosure for Law Enforcement

Under certain circumstances, HTM may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court, law enforcement or a government agency).

Other Legal Requirements

HTM may disclose your Personal Data in the good faith belief that it is necessary:

  • To comply with a legal obligation
  • To protect and defend HTM’s rights or property
  • To prevent or investigate possible wrongdoing in connection with the Apps
  • To protect the personal safety of users of the Apps or the public
  • To protect against legal liability

Sweepstakes, Contests or Promotions

When you choose to enter a sweepstakes, contest, or other promotion, and in accordance with the terms and conditions of the promotions, your Personal Information and Usage Data may be disclosed to our sponsors and to third parties who help administer the promotion, including in connection with winner selection prize fulfillment and aggregated data analysis. Your Personal Information and Usage Data also may be disclosed as required by law, such as on a winners list. Further, by entering a promotion, you are agreeing to the official rules that govern that promotion, including allowing our sponsors to use your name, voice, and likeness in advertising and marketing associated with the promotion in accordance with applicable law. All terms applicable to the particular promotion will be made available to you at the time you enter the promotion.

With Your Consent

We may share your Personal Information with other parties with your consent.

Security of Data

The security of your data is very important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

“Do Not Track” Signals

We do not support Do Not Track (“DNT”). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

Apps Providers

We may employ third party companies and individuals to facilitate our Apps (“Apps Providers“), to provide the Apps on our behalf, to perform Apps-related services or to assist us in analyzing how our Apps is used. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Analytics

We may use third-party Apps Providers to monitor and analyze the use of our Apps.

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Apps. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. You can opt-out of having made your activity on the Apps available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity. Behavioral Remarketing

HTM uses remarketing services to advertise on third party websites to you after you have visited and/or used our Apps. We and our third-party vendors use cookies to inform, optimize and serve ads based on your past visits to our Apps.

Google AdWords Google AdWords remarketing service is provided by Google Inc. You can opt-out of Google Analytics for Display Advertising and customize the Google Display Network ads by visiting the Google Ads Settings page: http://www.google.com/settings/ads Google also recommends installing the Google Analytics Opt-out Browser Add-on – https://tools.google.com/dlpage/gaoptout – for your web browser. Google Analytics Opt-out Browser Add-on provides visitors with the ability to prevent their data from being collected and used by Google Analytics. Payments

We may provide paid products and/or services within the Apps. In that case, we use third-party services for payment processing (e.g. payment processors). We will not store or collect your payment card details. That information is collected and provided to our third-party payment processors directly by our shopping cart solution, which is hosted and managed by Infusionsoft, who provides us with the online-ecommerce platform that allows us to sell products and services to you. Your data is stored through Infusionsoft’s data storage, databases and the general Infusionsoft application on a secure server behind a firewall. Our payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. Links To Other Sites

Our Apps may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Children’s Privacy

Our Apps does not address anyone under the age of 13 (“Children”). We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your Children has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers. Your California Privacy Rights Under California Law SB 27, California residents have the right to receive, once a year, information about third parties with whom we have shared information about you or your family for their marketing purposes during the previous calendar year, and a description of the categories of personal information shared. To make such a request, please send an email to the email address provided in our contact information below and include the phrase “California Privacy Request” in the subject line along with your name, address and email address. We will respond to you within thirty days of receiving such a request.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via email and/or a prominent notice on our Apps, prior to the change becoming effective and update the “effective date” at the top of this Privacy Policy. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.

Updating Personal Information

Upon request, we will permit you to request or make changes or updates to your Personal Information for legitimate purposes. We request identification prior to approving such requests. We reserve the right to decline any requests that are unreasonably repetitive or systematic, require unreasonable time or effort of our technical or administrative personnel, or undermine the privacy rights of others. We reserve the right to permit you to access your Personal Information in any account you establish with this app for purposes of making your own changes or updates, and in such case, instructions for making such changes or updates will be provided where necessary.
